1. Introduction and Acknowledgment of Risk
Divecenter (Mauritius) Dive & More Ltd, with its registered office at Main Road, St Martin, Baie du Cap, Mauritius, is the appointed service provider by SALTLAKE RESORTS Ltd to offer boathouse and watersports activities to guests of the Outrigger Mauritius Beach Resort. For the purposes of this declaration, Divecenter (Mauritius) Dive & More Ltd is referred to as “the Boathouse.”
By signing this declaration and participating in any activity offered by the Boathouse, the undersigned—and any accompanying family members or minors under their responsibility—acknowledges and accepts that these activities involve inherent risks and potential dangers. Activities include, but are not limited to:
- Stand Up Paddle
- Snorkeling
- Kayaking / Canoeing
- Pedalos / E-Pedalos
- Glass Bottom Boat
- Windsurfing
- Sailing
- Any other activity provided by the Boathouse
2. Health and Medical Information
The undersigned agrees to disclose in advance any relevant medical condition or health issue that may affect participation in the activities, including but not limited to:
- Chronic illnesses
- History of accidents or injuries
- Seizures or convulsive disorders
- Allergies (including to medications or marine environments)
- Recent surgeries or hospitalizations
- Ongoing treatments or rehabilitation
This information is necessary to ensure proper safety and emergency preparedness.
3. Assumption of Risk and Waiver of Liability
The Boathouse undertakes all reasonable precautions to ensure guest safety. However, by signing this declaration, the undersigned acknowledges and voluntarily accepts that participation is at their own risk. Accordingly, the Boathouse, and any associated staff, instructors, or agents shall not be held liable, whether directly or indirectly, for any:
- Personal injury
- Death
- Property loss or damage
- Financial or other consequential loss
- Any incident arising from participation in the Boathouse activities
This waiver applies to the undersigned and to any accompanying family members or minors.
4. Medical Emergencies
In the event of an accident, illness, or other emergency, the undersigned authorizes the Boathouse, any associated staff, instructors, or their agents to:
- Take appropriate action as deemed necessary
- Seek and arrange for medical or emergency treatment for the undersigned or any minors or dependents under their care
All related expenses shall be borne by the undersigned.
5. Equipment Use and Responsibility
All equipment provided by the Boathouse is assumed to be in good working condition at the time of use. The undersigned agrees to:
- Use equipment responsibly and in accordance with instructions
- Accept full liability for any damage or loss of equipment during use
- Pay the cost of repairs or replacement in the event of damage
- Pay the full replacement value in the event of loss
6. Safety Regulations and Conduct
The undersigned agrees to comply with all Boathouse rules and safety measures, including but not limited to:
- Mandatory wearing of life jackets during all nautical activities
- Following safety instructions provided by staff and instructors
- Not participating in activities while under the influence of alcohol or drugs
- Supervising accompanying minors at all times
- Respecting all posted safety notices and guidelines
7. Privacy and Data Protection
In connection with the services provided, the Boathouse may collect and process certain personal information, including:
- Full name
- Date of birth
- Email address
- Signature
- Health or emergency-related information (if applicable)
This data is collected voluntarily and is necessary for:
- The provision and management of services
- Ensuring health and safety
- Compliance with legal and regulatory requirements
Your data is processed securely by the Boathouse and its authorized service providers, including Firebase services, which operate on Google’s global infrastructure. These service providers act as data processors, subject to strict data protection obligations. We ensure that:
- Personal data is not retained longer than necessary
- Reasonable security measures are in place to prevent unauthorized access, alteration, or disclosure
Please note that while we strive to protect your information, no system is entirely secure, and we cannot guarantee absolute data security.

8. Governing Law and Jurisdiction
This declaration is governed by the laws of the Republic of Mauritius. Any disputes or claims arising from or in connection with this agreement shall fall under the exclusive jurisdiction of Mauritian courts.
